Gay couple turned away 3rd time by Rowan (Ky) clerk

MOREHEAD, Ky. James Yates and William Smith Jr. left the Rowan County Courthouse on Thursday, frustrated that clerks have now refused them a marriage license for third time.

The couple said they felt that Rowan Clerk Kim Davis was obligated to provide the paperwork after appellate judges refused to stay a federal injunction against Davis on Wednesday. But a deputy clerk said he was under orders to turn them away.

"It's just making us want to press more," Yates said. "She can't get away with this."

The couple said they plan to return and try again next week.

Or jail her for contempt.

She should not be able to continue rejecting lawful applicants.

MOREHEAD — Rowan County Clerk Kim Davis continued to withhold marriage licenses from local residents Thursday, a day after a federal appeals court upheld an order telling her to end her protest.

James Yates and William Smith Jr. were turned away by a deputy clerk in Davis' office Thursday morning when they asked for a marriage license. The deputy told the men Davis believes she can legally withhold marriage licenses until Aug. 31, next Monday, under an order issued earlier this month by U.S. District Judge David Bunning.

Davis has refused to issue any marriage licenses since the U.S. Supreme Court legalized gay marriage June 26. Thursday was the third time Yates and Smith had requested a marriage license from her office, and they were visibly upset.

Davis remained behind a closed door inside her personal office and declined to appear or comment.

the situation, but surely there is someone up the chain from Kim Davis who can direct that "unnamed" clerk pictured there to obey the law. And she needs her ass in jail for contempt.
