http://abcnews.go.com/US/wireStory/grand-jury-indict-man-shot-texas-deputy-22394749A Central Texas man who shot and killed a sheriff's deputy entering his home will not be charged with capital murder, attorneys said Thursday.
A local grand jury declined Wednesday to indict Henry Goedrich Magee for the Dec. 19 death of Burleson County Sgt. Adam Sowders, who was part of a group of investigators executing a search warrant for Magee's rural home.
"I believe the evidence also shows that an announcement was made," Renken said. "However, there is not enough evidence that Mr. Magee knew that day that Peace Officers were entering his home."

Peace Officers and no knock warrants don't go together.

(12,157 posts)Texas which has long had laws permitting a property owner to use deadly force to protect his/her property. The worst no knock debacle occurred near Waco at the Branch Davidian compound. The ATF agents killed the Davidian's dogs and that alone gave the Davidians the right under Texas law to use deadly force.
Whether you agree with the law or not it is the law and you would think law enforcement types would be aware. I am sorry for the death of the deputy and feel for his family and friends but when you break into someone's home you should be wearing full body armor.

Get a warrant, and it had better be legit.
Be sure to produce the warrant and give the occupants ample time.
Remember that not every inhabitant of a constitutionally protected home or space CAN FUCKING HEAR YOU.
And to think that the assholes want us to throw out the second amendment.
Do that and no-knock warrants will become the norm.
