Maine gun store may be shut for refusing to let ATF copy records

SANFORD — The federal government is trying to revoke the license of a gun store owner who refused to allow a federal agent to copy gun records during a compliance inspection last year.

Phil Chabot, who owns Pac N Arms on Emery Street in Sanford, was issued a notice of revocation in February by the Bureau of Alcohol, Tobacco, Firearms and Explosives. The bureau got a warrant to search Chabot’s store in February, and court records indicate he is suspected of making “straw sales” – sales through an intermediary – to a convicted felon who was barred from buying or possessing guns.

Chabot has not been charged, and his lawyer said Tuesday that they had not seen any evidence against him.

Chabot, who has been licensed to sell firearms since 1991, has accused the ATF of overstepping its authority and has run advertisements in local media, including the Portland Press Herald, asking any customer who is contacted by the bureau to call his lawyer.

1. Seems like there's a very easy solution there - let the shopowner's attorney

watch while ATF copies the specific records they think they need, and in the process the ATF agent can explain why each one is being copied. If the explanation isn't satisfactory, then take those records to a judge...

The first search was "warrantless," according to the article. Now the ATF is applying for a warrant. Shouldn't they have done that in the first place? Routine inspection is one thing, but they were looking for specific evidence of a crime. Ergo, wouldn't a warrant be ... warranted?

Or two ladies are out delivering papers,
or someone is holding a cellphone
or a man with diminished capacity doesn't drop fast enough after two officers give conflicting orders
or an off duty cop gives chase and decides to give the runner the Gump Shot

I am more than with the idea of him doing time in Fed Prison after a trial and sentencing.

And as a bonus no one has to die when Agent Fife sprays 30 9mm rounds in a citizen ( and the wall, and the door, and the business behind them, and the floor.....) for not respecting their authoriteh.

But I mean we all are here to decry the loss of life caused by guns...

can not be out of the possession of the FFL. Had a situation similar to this several years ago at a gun shop I worked at part time. The ATF wanted to photocopy several 4473 forms. The owner of the store said fine, but they do not leave our possession. ATF just rented a photocopier, brought it into the shop and copied away. No problem.

ATF has changed some, the Agents we worked with were reasonable, helpful, and pleasant. Not so much anymore.

ATF= Always Think Forfeiture
