Judge: Fleet Farm must hand over gun sales records in straw purchase lawsuit

A federal judge says Fleet Farm must turn over records of handguns sold from its Minnesota stores as part of an ongoing lawsuit involving potential straw purchases.

The sporting goods retailer must produce sale logs that identify customers who purchased four or more handguns within a two-week period.

Magistrate Judge John Docherty said Tuesday those records will be "sufficient to show purchasing patterns" at the retailer’s 17 Minnesota locations.

Tuesday’s ruling is part of an ongoing lawsuit that accuses the corporation of not doing enough to stop customers from illegally purchasing firearms for someone else – commonly known as straw purchases.

Normally I would object to a fishing expedition of a seller's records. However, when a straw purchaser has been traced to a dealer it is quite reasonable to review records to see if there are any others who may have been making straw purchases.

when there is sufficient evidence of a pattern of offenses even this RKBA supporter supports the record turnover. I do not support this practice in all cases for all stores. That would be a clear violation of the meaning and intent of this law. In this case, the judge got it right. I would love to see EVERY straw purchaser caught and prosecuted. They are a scab on the ass of law-abiding gun owners and make the general population think that we are all crooks. Most of us try to follow the spirit and the letter of gun laws. Get clowns like this off the streets.
