Authorities say the homeowner heard a loud bang and then his alarm go off. After arming himself with a gun the homeowner says he saw the burglar at the top of his stairs and shot at him twice, hitting him once.

News 13 wanted to know why Garcia was not in jail and discovered he was ruled incompetent to stand trial this past December. With that ruling a judge ordered the dismissal of his three 2011 cases and ordered his release from jail.
A spokesperson for the District Attorney's office says their hands are tied. The only way they could argue for Garcia to remain locked up, even in a mental health facility, is if his crimes were of a violent nature and the crimes he's charged with do not fit the legal requirements.

(54,770 posts)In any event, it is hard to applaud shooting an unarmed, non-violent person. Well, unless the shooter is one of those gunsters who would never waste a chance to shoot someone and be a hero to those who believe guns are the answer.

(18,482 posts)...he needs to be released into the care of a responsible person. That person is now responsible for his actions. By the third incident (the second time that the 'responsible' third party failed their obligation) the courts should have learned their lesson. Fool me once, shame on you; fool me twice, shame on me.

(10,136 posts)"mentally incompetent to stand trial" and "need to be under constant supervision" are two very different standards with a huge gap between them. A recent court case in WA resulted in similar questions which lead to some interviews with lawyers who tried to explain how the two systems don't necessarily work together.
