Fatal Walla Walla break-in shooting protested

It's been a month since a 22-year-old man was killed during a break-in at a store in Walla Walla.

The family and friends of Cesar Chavira have been protesting the shooting. They marched through the city Monday, demanding that the store owner who fired the fatal shot be prosecuted.

The owner of the New York Store Western Outfitters, John Saul, lives on the property. His lawyer, Michael Hubbard, says Saul was defending his property from a burglar.

KVEW reports ( http://is.gd/cxF002) the police investigation was turned over Friday to the Walla Walla County prosecutor who will decide whether Saul will be charged.

Chavira's supporters are claiming that he was outside the store when he was shot in the back. Corner's details have not been released, nor has surveillance video so we don't know if that is true or not.

WALLA WALLA — The investigation continued Saturday into a shooting that left one man dead and deputies searching for answers to what happened just before several shotgun rounds were fired early Friday morning during a burglary attempt at the New York Store, 2254 Isaacs Ave.

Investigators with the Walla Walla County Sheriff’s Office said that on Friday at 2:30 a.m., Cesar Chavira, 22, was shot and killed by store owner John Saul, who may have fired as many as five shots at Chavira.

“He (Chavira) was stealing belt buckles and belts and was confronted by the store owner,” Walla Walla County Undersheriff Edward Freyer said, adding it was unclear how much time elapsed during the incident. “We don’t know the exact timing and sequence, but at some point in time, gunshots were fired.”

On Friday, Freyer told a reporter for KTEL that Saul provided a “very limited statement” and then asked to speak with an attorney.

The shooting has led to more than 300 postings on the Union-Bulletin Facebook page in less than 30 hours, including at least one comment from Mark Fullen, who operates a Tri-Cities-based security business.

In his comment, Fullen claimed to have viewed the surveillance video from the shooting.

In a Union-Bulletin interview, Fullen declined to comment on the tape and would not confirm if he had turned over a copy to authorities.

The attorney for John Saul, owner of The New York Store, says his client fired in self-defense.

Saul claims to have been asleep on a mattress in a back room when he heard someone smashing through a store window. He says, after several previous robberies, he had a shotgun ready, and told the intruder to "hold it".

That's when he claims the thief threatened to kill him. So, Saul says, he opened fire.

Cesar Chavira was killed by at least five shotgun wounds. The Sheriff's office says Chavira was a known gang member with a criminal history. But they tell Action News they are still investigating exactly what happened.
