Again, someone tries to check their firearm in NYC.

Ryan Jerome was enjoying his first trip to New York City on business when the former Marine Corps gunner walked up to a security officer at the Empire State Building and asked where he should check his gun.

The 28-year-old with no criminal history now faces a mandatory minimum sentence of three and a half years in prison. If convicted, his sentence could be as high as fifteen years.

“If he does get indicted, and they want to give him something less, then the legal minimum would be two years,” noted Mark Bederow, Jerome’s attorney. “They couldn’t even offer less if they wanted to.”



Apparently he did not check a good source online about the laws in NYC, as he was under the impression that it was legal. Goes to show you cannot trust the internet for sound legal advice.

Unfortunately, the Court did not say the legal equivalent of "Simon says," so unconstitutional enclaves get to keep thumbing their noses at the Bill of Rights.

Logically, states should be compelled--by force if necessary--to respect "the right of the people to ... bear arms." The criminal thugs in New York City, Chicago, Hawaii, California, New Jersey, DC and other enclaves will have to have their legal asses soundly kicked first, probably repeatedly.

Actions that are perfectly legal in 99% land turn you into an instant criminal when you cross the NYC limits.

The stunning investigation had 16 officers in Bronx Criminal Court Friday, answering to charges. Hundreds of their colleagues were there in a dramatic show of support as all the officers pleaded not guilty in connection with the investigation.

what with their arresting people for exercising otherwise completely legal, in fact constitutional freedoms..

A photographer recently spent 37 hours in jail after being singled out by the NYPD for taking pictures of Occupy Wall Street protesters.

bargain for a guilty plea to something like 'disorderly conduct' to avoid outrageous mandatory minimums..it happens all the time.

The last time this happened with a guy from Florida, they chose to try to convict him of criminal possession of a loaded firearm.

Took the jury less than 30 minutes to come back with a not guilty.

Security theater being what it is, chances are that outside an airport or a courthouse, nobody's actually going to check whether you're carrying, and not to put too fine a point on it, if they can't be fucked to enforce their chickenshit rules, why should you make their lives easier?

We all know my tale of trying to park in the Ronald Reagan building's public parking lot in April 2003.

Identification please. Uh, identification? We're Canadian. We didn't know we would need identification to park. Nobody really knows what a Canadian looks like (it's our secret weapon, the way we blend in), so he might have been able to pass.

It might not have worked for us, of course, if my friend who was driving her locally registered car hadn't had her Langley employee ID with her ...

It worked with most speed limit enforcers, though.
