The Santa Clara District Attorneys office will not file criminal charges against 49ers Ray McDonald following his arrest on suspicion of domestic violence.
All domestic violence complaints deserve our concern, sensitivity and careful review, District Attorney Jeff Rosen said. After our thorough review of all the facts, we do not have evidence sufficient to convince a jury beyond a reasonable doubt that Mr. McDonald committed a crime against Jane Doe."
The decision concludes a nearly 10-week investigation of the defensive lineman by San Jose police detectives and prosecutors from the District Attorneys office.
McDonald was arrested in the early morning hours of Aug. 31 at his San Jose home following a party he hosted to celebrate his 30th birthday. McDonald was said to be involved in an altercation with his pregnant fiancée. Police disclosed little information about the incident other than a brief synopsis that stated the victim had visible injuries. McDonald was released on $25,000 bail later that morning.
I feel bad for his fiance'. This case was doomed from the get-go. The officer who was working for the 49ers never should have gone to his house (he was there for the party, too) before other officers arrived.
