Marta says he only pushed her when she refused to get out of his face. That's when...she claims she turned and smashed her head into a flat screen TV in their bedroom...(S)he describes how profusely she was bleeding and says, "I started yelling because it hurt quite a bit and I was very worried about whether I was going to need stitches and worried about how it would look." She says they decided to go to the ER around 11:30 PM.
Marta, whose first language is Russian...claims she repeatedly told a police officer Slava did not try to kill her, and she was not afraid of him...(They) believe the officer did not understand her because her English is so poor...Police testified the she had said Voynov punched, kicked and choked her. So, it appears there was a communication gap, or someone's lying.
Marta ends the letter by pointing out she's "heard about other athletes on the news" who did things that Slava didn't, yet they were not charged. She's clearly referring to Ray Rice. who got a pretrial intervention program instead of being prosecuted for punching his then-fiancee.
According to reports of police testimony Monday, an officer of the Redondo Beach Police Department told the court that Voynov had punched, kicked and choked his wife, Marta Varlamova, at the couple's home in October.
(T)hrough his California-based lawyer...(he) maintains his innocence, and Voynov's wife has also stated through her personal attorney that the incident was an accident and that she does not want her husband charged...
Voynov, who was arrested at the hospital after medical staffers called police, was immediately suspended by the NHL and has not played a game since Oct. 19...Voynov is set to be arraigned Dec. 29.

with or without a divorce settlement.
Oh, and Slava didn't kick her -- according to the letter she sent the DA, "(He) pushed me away because he wanted to stop talking...I fell down and Slava tried to walk past me...I was blocking his way, so he tried to move me with his legs..."
As for choking her, the marks the police saw on her neck were probably just the result of Slava applying pressure to stop the bleeding from the cut on her eyebrow:
"Slava and I were both very surprised. I had never seen so much blood from a cut...I started screaming very loudly...Fortunately, it didn't wake (her 7-year-old daughter)...I told him not to help me...I was very mad at him...but he bought me some water and towels anyway...We quietly left for the emergency room..."
A police officer testified that she said she'd been choked, kicked and punched -- see how much can get lost in the translation?

During the(ir) dispute...at (the) Halloween party...Wiist said...Voynov removed some costume glasses from her face, threw them to the ground and stomped on them. The argument then continued outside...Mr. Voynov struck her in the face with his fist, Wiist said. They returned to the party and eventually went home, where the argument rekindled and escalated into violence, Wiist said.
Voynov, he said, threw his wife to the floor multiple times. He repeatedly kicked her all over her body in addition to choking her approximately three times, Wiist said. Varlamova, who returned to the house with the officer and showed him her bedroom, told Wiist that Voynov shoved her into the flat-screen television. When he pushed her into the TV, she struck her face on the corner, Wiist said. She stated that she asked him to stop. She was screaming and indicated she was scared. Voynov did not stop, Varlamova told the officer, until he saw the blood coming out of her face, Wiist said.
Varlamova...told the officer she asked him to call for help. Instead, he called a friend...The couple left her 7-year-old daughter...home alone for 2?½ hours while they were at the hospital, Wiist said. The gash above Varlamovas eye required eight stitches, her face was swollen, and she had bruises, red marks, and scratches on her neck, Wiist said. The officer asked Varlamova if her husband had choked her and she told him Voynov had put both of his hands on her throat...
Combine that with the fact that a neighbor called 911 about hearing screams and crying, and the defense is going to have quite a language barrier to overcome -- not to mention Slava's consciousness of guilt.

After...Marta Varlamova arrived at Providence Little Company of Mary Medical Center...on Oct. 19 for treatment of a 1.2-inch cut above her left eye, a nurse asked if the injury was her husbands fault. (The nurse) asked Ms. Varlamova if this was the first time he had done that to her, the motion says, citing a report by a Redondo Beach police officer. Ms. Varlamova responded no. ...(According to) notes from a social worker at the hospital excerpted in the court documents..."(Varlamova) admitted to LCM triage staff that this was not the 1st time she had been assaulted.
...Voynovs attorneys said that Varlamova doesnt understand English well and wasnt provided a Russian translator during the interviews...The court documents describe the questions posed by police as coercive and say the officers had already decided upon a version of events...Based on the totality of the circumstances...Ms. Varlamovas pretrial statements...were involuntary, and Mr. Voynovs constitutional due process rights to a fair trial will be violated if these statements are admitted at trial. ...Voynovs attorneys called the social workers statements hearsay within hearsay.
...The next hearing in Voynovs case is Feb. 25...Voynov, who is suspended indefinitely with pay, is scheduled for a March 2 trial on a felony domestic violence charge in connection with the alleged incident...If convicted, he faces a maximum of nine years in state prison.
Seeing as she said nothing in her letter to the DA about the violence that occurred at the Halloween party prior to the incident (was it witnessed?), this isn't going to help her credibility.

The standoff and a court filing made on her behalf prompted Judge Eric Taylor to reschedule Voynovs domestic violence trial from April 21 to July 8. A hearing will be held May 4 to again determine whether Deputy District Attorney Frank Dunnick can compel Marta Varlamova to testify or whether she will not have to respond to his questions...
Ms. Varlamova has legitimate concerns about her privacy and her personal well-being and desires to avoid the emotional trauma, embarrassment and destruction of her privacy that would result from being compelled to testify in this case, (her attorney) Michael Walsh wrote... She is not willing to answer any questions concerning the subject matter of this case.
She has "legitimate concerns about her well-being and privacy?" That (along with being referred to as Ms. Varlamova by her lawyer) sounds a lot more like she's been threatened with divorce. Have they been going to counseling, at least? If both the Voynovs want to avoid a trial, they should have worked out a plea deal by now.

LA Times.com:Slava Voynov pleaded no contest to a misdemeanor count of corporal injury to a spouse Thursday in Los Angeles County Superior Court in Torrance as part of a deal to resolve the case stemming from an incident with his wife...(which) opened a 1.2-inch gash above (her) left eye...(She) had refused to testify if the case went to trial...
The Kings defenseman was sentenced to serve 90 days in jail the actual amount is expected to be 45 days or less based on good behavior and other factors and he will be on probation for three years. Voynov must also complete a 52-week domestic violence prevention program and perform eight hours of community service, the L.A. County district attorney's office said.
"Mr. Voynov's status vis-à-vis the NHL remains unchanged," (said the)...NHL Deputy Commissioner..."When he is ready to proceed with us, we will be prepared to discuss next steps and a process for determining his NHL eligibility status moving forward." The plea might lead to immigration issues for Voynov, who is a Russian citizen.

Mr. Voynov entered the U.S. in 2013 on a temporary visa for internationally recognized athletes. The agency did not allow a bond because of the violent nature of Voynov's case, a common move in situations where Immigration and Customs Enforcement feels the person poses a danger to the community or is a flight risk...
The NHL suspended him with pay after the arrest. In late June, the Kings suspended Voynov without pay after he tore his Achilles' tendon in a non-hockey incident...(A) San Diego lawyer who specializes in immigration matters said an option open to Voynov is to voluntarily leave the U.S. immediately and reapply for a visa...
