Scalia has died!!!

Senior U.S. Supreme Court Associate Justice Antonin Scalia found dead at West Texas ranch

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.

According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

The U.S. Marshal Service, the Presidio County sheriff and the FBI were involved in the investigation.
Officials with the law enforcement agencies declined to comment.

His ideology was awful and his decisions were very wrong, but I still offer condolences.

With that said, we are in for one contentious Supreme Court battle. This is for the balance.

is that the filibuster is something that the minority party uses in order to prevent a vote from going forward. Since the GOP has the majority they can simply vote en masse to deny confirmation to any appointee.

of the Senate is to "advise and consent." IOW, the Republicants can stand firm and deny confirmation to anyone. I'm not sure what the president can do then. But there is no reason at this point for the Rs to confirm anyone Obama appoints. They know that there is an election in nine months, and that there is a good chance the R candidate will win. If that seat is vacant for most of the next year, they won't care.

Their duty is to ensure that laws passed by Congress are Constitutional.

I have no idea what will happen with their decisions. There could be a lot of ties, in which case I would assume those cases get punted to next year.

So much legislation that is passed is overturned or meddled with by the Supreme Court it is hard to remember they didn't pass the legislation in the first place. Many laws that have passed the congress have been constitutional, however the activist court finds a way to deny the fact, I suppose constitutionality is in the eye of the beholder.

My condolences to the family of Antonin Scalia. As for the rest of us, this is definitely a game changer, this makes this election more important than ever. This will also give President Obama an opportunity to replace him on the court. I sure hope he will nominate someone that is not Wall Street friendly.

Barack Obama is the President for another 340+ days.

If we were attacked, would the GOP demand a response be delayed until November?
If the nation was suddenly felled with natural disasters, should the aid be earmarked for the next POTUS?

The president nominates justices. That is part and parcel of our government. Anyone in that government refusing to do their job should be immediately renditioned to Gitmo (that abomination is still in existence due to the GOP, the President still holds the supreme executive authority to have ANYONE suspected of ANY CRIME sent to that hole...I say grab McConnell and anyone else who opines against the consititutional role of the office of the president for the next 11 months.

FILL THE COURT NOW....I would prefer that it be before Scalia's corpse is fully stiff.

He and Stevens wrote a wonderful defense of Habeas corpus and due process for detainees in their dissenting opinion in Hamdi v Bush, for example, and he many times defended fourth amendment rights as well as other rights in the bill of rights. I disagreed with him more than I agreed with him, but he was not just a conservative ideologue, as some like to suggest. He actually had to defend his opinions with serious legal arguments, and he was quite skilled at doing so.

Ginsberg, who I adore, was his friend, and like her, I respect him in spite of my many disagreements with him.

This is a GREAT DAY for celebration, that evil clown is gone. just one in a pile of these creeps, I hope to see Cheney joining him soon in that special place Hell they love to pretend exist. For us to be charitable about this cretin is beyond ridiculous.

This guy was pivotal for a great deal evil that fell upon the world in the 2000 elections and since.

So please, this is a moment to celebrate even if briefly.

that doesn't mean this Congress won't vote "no" on every nominee though...

I suspect they will simply vote no on anyone for the next 9 months

until the new republican president is sworn in next January.

This probably means next June's big decisions will be 4-4 ties - could be quite interesting.

are with those who knew and loved him, but that's it. I will not miss him on the court, his contribution to bad rulings, or him speaking out against minorities. And I agree--this could be the beginning of a major pendulum shift on the court, particularly if Hillary or Bernie wins in November. The next president may be able to appoint as many as 3 new justices, or even more! Plus, even if the GOP Senate blocks the president from appointing a new judge, many R's are up for re-election this year. So there would be even more evidence of them standing in the way of getting things done.

Between Hillary, Bernie, and Obama, he has by far the best chance of getting one approved.

IF not (as I've been saying), the other two -- especially Hillary because she's especially hated -- don't have a hope in hell.

Everyone should stand together and demand the GOP back off and Let President Obama's pick to replace Scalia through. They are already saying "NO"! He has the obligation and the right to pick someone now, he is not out of the WH for another 340 odd days.
Like Bernie says, "stick together and we can do anything" , example clearing his name on picture-gate

You know Marfa is a part of Texas with a lot of UFO lore. I can't help think of the possibilities of what might have given him the heart attack or stroke, or whatever it was that killed him. A visit from Grays anyone?
