Senior U.S. Supreme Court Associate Justice Antonin Scalia found dead at West Texas ranch

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.
According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.
The U.S. Marshal Service, the Presidio County sheriff and the FBI were involved in the investigation.
Officials with the law enforcement agencies declined to comment.

Edited to add, mods I know this isn't strictly a campaign issue but I believe Scalia's death is going to have some impact as SCOTUS picks are a big part of choosing a candidate

(466 posts)is that the filibuster is something that the minority party uses in order to prevent a vote from going forward. Since the GOP has the majority they can simply vote en masse to deny confirmation to any appointee.

(466 posts)of the Senate is to "advise and consent." IOW, the Republicants can stand firm and deny confirmation to anyone. I'm not sure what the president can do then. But there is no reason at this point for the Rs to confirm anyone Obama appoints. They know that there is an election in nine months, and that there is a good chance the R candidate will win. If that seat is vacant for most of the next year, they won't care.

I have no idea what will happen with their decisions. There could be a lot of ties, in which case I would assume those cases get punted to next year.

(1,508 posts)So much legislation that is passed is overturned or meddled with by the Supreme Court it is hard to remember they didn't pass the legislation in the first place. Many laws that have passed the congress have been constitutional, however the activist court finds a way to deny the fact, I suppose constitutionality is in the eye of the beholder.

My condolences to the family of Antonin Scalia. As for the rest of us, this is definitely a game changer, this makes this election more important than ever. This will also give President Obama an opportunity to replace him on the court. I sure hope he will nominate someone that is not Wall Street friendly.

I don't think they will trust Trump with the appointment, so I'm thinking Jeb might see a boost.

The president nominates justices. That is part and parcel of our government. Anyone in that government refusing to do their job should be immediately renditioned to Gitmo (that abomination is still in existence due to the GOP, the President still holds the supreme executive authority to have ANYONE suspected of ANY CRIME sent to that hole...I say grab McConnell and anyone else who opines against the consititutional role of the office of the president for the next 11 months.
FILL THE COURT NOW....I would prefer that it be before Scalia's corpse is fully stiff.

(9,289 posts)He and Stevens wrote a wonderful defense of Habeas corpus and due process for detainees in their dissenting opinion in Hamdi v Bush, for example, and he many times defended fourth amendment rights as well as other rights in the bill of rights. I disagreed with him more than I agreed with him, but he was not just a conservative ideologue, as some like to suggest. He actually had to defend his opinions with serious legal arguments, and he was quite skilled at doing so.
Ginsberg, who I adore, was his friend, and like her, I respect him in spite of my many disagreements with him.

This guy was pivotal for a great deal evil that fell upon the world in the 2000 elections and since.

(10,893 posts)are with those who knew and loved him, but that's it. I will not miss him on the court, his contribution to bad rulings, or him speaking out against minorities. And I agree--this could be the beginning of a major pendulum shift on the court, particularly if Hillary or Bernie wins in November. The next president may be able to appoint as many as 3 new justices, or even more! Plus, even if the GOP Senate blocks the president from appointing a new judge, many R's are up for re-election this year. So there would be even more evidence of them standing in the way of getting things done.
