That is likely the minimum, depending on who wins the GE. And if it's us, it will depend on what the Senate races did. If they lose the Senate, they MIGHT just decide not to wait.

obama will nominate someone above reproach. the rw gop will stomp up and down like two year olds, and they will lose the wh in a near landslide.

obama will not back down on this. i hope and hope.

While I am sure he already has a short list of people at the ready there is some prep work that needs to be done before an announcement can be made. He won't have a pick ready until after the funeral anyways.

...who's a Texas crazy, already had a post up of some resolution that he feels the Senate should use to hold up any Obama nominees. Didn't even wait 24 hours to try and hold up the country. Some patriot.

Since this is an election year, and we can't easily forget 2000 (Nader was not the spoiler), what if it's a tie and we need the Supreme court to intervene on the election??


If there isn't an odd number (ie Scalia not replaced), what happens??

Is there a statue or law or something that says how long the SCOTUS can go without a full 9 justices seated??
