Bernie doesn't become the nominee.
Hillary's delegates will be freed to vote however they wish, and the super delegates can do whatever they want. A third party will be the nominee.

(2,510 posts)Almost ANY nominee other than Hillary would be a game-changer for me. She is simply unacceptable because of her neoconservative foreign policy, and pro right-wing meddling in Honduras, all of which has resulted in the loss of so many innocent lives.
If I wanted a president who would throw buckets of innocent blood on MY hands, I would have voted for Jeb Bush in the Republican primaries. I sure don't expect Bush's neocon sister to be shoved down my throat from within the Democratic party.

(39,215 posts)create a 3rd party. They are only allowed to vote within the party. That is what they are for. They have three choices in that case: vote for Bernie, refuse to vote at all or to vote for someone who has not been running and has no elected delegates at all.
And I don't think that the votes Hillary gets can be taken out of the party either. What good would they be? Their purpose is to choose a candidate for the Democratic Party. They have no meaning outside that.
If this is the case you can bet that before the ink is dry on the paper there will be NO Democratic Party ever again.

(5,636 posts)... and my guess is that she would. To my knowledge there's no rule that frees her delegates if she's indicted. I'm not even sure her delegates would be freed if she was convicted. At any rate, let's not forget innocent until proven guilty.

AND Hillary's delegates would still be bound to her on the first round vote, and only released on a second round of Bernie didn't have reach 2,383 on the first round. But he would because he would finish the primary uncontested.

(59,504 posts)The question is what would a vote for HRC mean at that point? A genuine vote of support for her hoping she blows off being indicted as "proven until convicted". A vote for someone not running who might be endorsed by HRC or maybe Obama.
The ONLY other person on the ballot is O'Malley - I doubt that he would be encouraged to run with the idea that he could get some of her votes plus votes he gains in the second half. No one else can now get on the primary ballots in most, if not all states.
I actually do not think she will be indicted. I think worse case will be if one or more of her aides are and it is an issue in the election with her as the candidate.
