A letter sent by FBI Acting Assistant Director Jason Herring to the House Oversight Committee confirms that the three emails media is making such hay over did not originate with Secretary Clinton, nor was the use of the term "extremely careless" meant to establish some mythical standard of conduct which did not exist before Director Comey's statement.
Herring also specifically compared the Clinton emails with the prosecutions of Bryan Nishimura, David Petraeus, and Sandy Berger. In all of those cases, the FBI said, there was "clear evidence of knowledge and intent," which was not present in this investigation.
As for the term "extremely careless," Herring explained that the term was "intended to be a common sense way of describing the actions of Secretary Clinton and her colleagues." He further clarified that "the facts did not support a recommendation to prosecute her or others within the scope of the investigation for gross negligence."
This will surely not deter the spittle-flecked Trump supporters out there shouting "Lock her up!" But for those who encounter people who are only marginally paying attention, the two takeaways here are as follows:
1. Clinton did not send emails with information marked classified in them. She received them.
2. There was no intent on her part -- or her staff's -- to share classified information with people not entitled to see it.

(3,284 posts)who are convinced that she's done something so HORRIBLE, so criminal, that she should be put in prison. It's just weird to me. Especially when they support Trump and think he's done nothing wrong himself.
It's like proposing life in prison for someone who didn't return a library book on time, then turning around and campaigning for a serial killer to become president. Just completely off-the-wall NUTS.

I think they think that if they hit her over and over with scandal after scandal, something will stick, tapping into that vast swath of anti Clintonism that was rampant in the 90's and is still embraced today, not only by the right. What they are too short sighted to see, though, is that Big Dawg left office with a 66% approval rating, eight Benghazi investigations haven't destroyed Hillary, and even those folks who don't particularly care for her aren't necessarily swayed by Republican bullshit. And their candidate is so bad even some who do believe the bullshit will vote for her. Republicans have always underestimated the Clintons and overestimated their own ability to bring them down. Always.

In market check-out lines, restaurants, etc., they will start in with the shopworn talking points. A guy at my gym did exactly this recently, went on a long anti-Clinton diatribe. I noticed he had a "Hillary For Prison" sticker on his pickup.
These people have been exposed to decades of poison from the usual media sources. Somehow, they believe the lies. Fear? Laziness? Ignorance? It's a tragic mystery.

Seems like the government needs to ask Bill Clinton if they can use his server, the one protected by the Secret Service 24/7.

I don't know if was deliberate in that he was trying to undermine Hillary of if it was deliberate in that he was just annoyed at her and wanting to get back with some small jab, but I hope he rues ever uttering that little opinion. I hope he has to spend the rest of his life explaining and backpedaling on it, and that this example keeps the future director (and I'm sure there will be a new one soon), to stick to the facts and just the facts from now on.

It was blatant politicization of this issue; and, I believe, a bone thrown to the repub candidate and the House if they wanted to pursue their vendetta. No one else would have been subject to this type of treatment, with the possible exception of Bill.

(3,335 posts)His taking it upon himself to chastise her in his need to clarify things, led to more acrimony she didn't need or deserve, plus potentially more legal costs. Had he stuck to the Justice department guidelines and just given the simple one sentence used when the FBI decides not to indict, there would have been no reason to go up on Capital Hill to testify about the comments he made during his news conference, which shouldn't have been made in the first place. While Congress can subpoena anyone, they don't have automatic access to every piece of evidence that the DoJ has. Comey opened that door, when he began testifying before Congress that day. If he had followed DoJ protocol and limited his statement to their usual simple canned statement when the FBI decides there is not enough evidence to indict, he would not have had to answer any of their questions regarding what they had reviewed and how many letters he looked at, etc.

Holding that press conference, admitting his justification was the intense public interest about the matter, which should have been more of a reason not to hold one, was an egregious, prejudicial, political act on his part. It fed into the right wing narrative of her, gave the repub congress a reason to prolong their vendetta, and made sure her public chastisement was witnessed by millions of her detractors as well as those still not prejudiced against her. It was despicable of him to use his office in that way.

(2,072 posts)There is nothing extraordinary about pols and staffers being sloppy with sensitive material via various means of communication. This is still going on right now as we continue to analyze this to death -- government officials are using the .gov email system to exchange sensitive information and nobody is blinking an eye. Hell they are using post-it notes too! It is not an excuse, but things are happening at lightning speed and things would come to a screeching halt if everybody was second guessing and compartmentalizing every last thing. This is a knock on a system that needs overhaul not on the people that are using it.

Even the people who might believe a little of it, do not believe it is an issue that warrants such vindictive and hysterical hunting of her, outside of the right wing.

know that it was a charity.
BTW Trump is toast in OH because it is mid August and he doesn't even have an office in
Cincinnati. I have come to the conclusion that his run for President is just one more con.

Plus, you know how the job ages everyone who has it; somehow, I don't think Trump's vanity could take that. Imagine if what's left of his hair began to fall out! Heh.

(3,335 posts)Another erroneous piece of information that the GOP and some here have repeated is the lie that Government employees have to keep every email that they receive for FOIA. Government employees delete documents every day. Every document that comes through a federal office is not subject to FOIA. Also, you might not find out there is a recent FOIA request on something that was destroyed years ago, and that doesn't mean something nefarious is going on. It would just mean that the request came too late. I've always been on the safe side and tend to save everything for as long as possible. But, every office I've ever worked at, had limited space on our servers and in our email accounts and we were constantly reminded to purge our email archive files because management knew that we didn't need to save everything and they kept telling us that we need to clean out our email box, our files were getting too big. When we get FOIA requests or documents we know may be subject to FOIA, we usually forward those to a designated person responsible for acting upon those types of requests. Most government offices don't operate under an assumption that all emails or work product is subject to FOIA because it is not.

Were the emails miss-marked as classified by the faulty FBI markers, even though those emails were not classified when Hillary's server received them?
Does anyone remember when Republicans hacked into the Senate/House emails, government emails?
The government servers at that time were not safer.
