Breaking on Washington Post: Senior Justice Department officials warned the FBI.

Senior Justice Department officials warned the FBI that Director James B. Comey’s decision to notify Congress about renewing the investigation into Hillary Clinton’s private email server was not consistent with long-standing practices of the department, according to officials familiar with the discussions.

Comey told Justice officials that he intended to inform lawmakers of newly discovered emails. These officials told him the department’s position “that we don’t comment on an ongoing investigation. And we don’t take steps that will be viewed as influencing an election,” said one Justice official who spoke on condition of anonymity to describe the high-level conversations.

“Director Comey understood our position. He heard it from Justice leadership,” said the official. “It was conveyed to the FBI, and Comey made an independent decision to alert the Hill. He is operating independently of the Justice Department. And he knows it.”

Though Obama can press her to get Comey's resignation. Might look bad though as justice is supposed to operate independently. I don't see anything happening to comey until after the election.

“My first question is this, would you reopen the Clinton investigation if you discovered new information that was both relevant and substantial?” Rep. Lamar Smith (R-Tex.) asked Comey during the hearing.

“It’s hard for me to answer in the abstract,” Comey replied at the hearing. “We would certainly look at any new and substantial information.”

At this point he fails both tests. First he does not know if their are any previously undisclosed emails, and he doesn't know if they are substantial.

the laptop Mr. Weiner used for his sexting, if it was an old laptop where Mrs. W used even once to check her email. Or perhaps even if he looked at the Mrs. W email. Those emails would remain on that hard drive.

That congress question right there and comeys answer, tells whoever that if they can get Mr. Ws devices into FBI hands, Comey will have to speak to save his ass. Comey may not have known but someone else may have.

Comey again at the center of a highly partisan argument over whether the nation’s top law enforcement agency was unfairly influencing the campaign.

Unfortunately, he doesn't appear to be smart enough to figure out that the GOP is throwing him under the bus as the sacrificial lamb in their pull-out-all-stops effort to get Donald elected.

On November 9th, after Hillary Clinton has won the presidency, President Obama should publicly demand Director Comey's resignation. Or he should issue a press release that he's fired Mr. Comey... before he informs Mr. Comey!

Mr. Comey should be ashamed of himself and he's embarrassed himself and the FBI.

Because the optics that would've occurred on Nov. 7th if he hadn't disclosed what he did to Congress would have been devastating.

My assessment was that he was being set up, and the perpetrators (cough Rove cough) were PRAYING that he would NOT report to Congress.

I don't care WHAT so-called '60 day rule' there is in place ... Had it come out on November 7th that Comey had 'hidden' from Congress for 10 days right before the election that there exists emails that even MAY have been pertinent to the Clinton email investigation, all fukcing HELL would've broken loose.

Fact is, nobody (except the type of us folks here on DU) would've gave a rat's ass about some 'long-standing practices of the Department'. The media would've had a field day of the likes we've never seen, and the optics would've catastrophic. We're WAY, WAY better off that this came out NOW so it can be managed ... and the response by the Clinton Camp has been pitch-perfect as well. This was a last-ditch attempt at 'scandal generation' ... that just failed miserably.

Comey did us a favor, whether that was his intent, or not. Because I *PROMISE* you had he NOT reported this to Congress ... news of that action WOULD have come out RIGHT before the election. And it would've tarnished Comey SO badly ... it would've caused a frenzy of wild-eyed speculation from 100's of pundits all over the news shows, RIGHT before the election ... validating the fear that he'd 'been in the bag for Hillary' throughout the whole email investigation.

Yeah, no. We dodged a bullet here folks, I truly believe that.

FBI has lots of ongoing investigations, they don't reveal details to the press or congress (or even that they are investigating at all).
Why is that one any different?

The FBI doesn't normally inform the press, Congress, or anyone else about ongoing investigations unless there is a compelling reason to do so. In this case, there's a compelling reason not to; several in fact. Among them: FBI policy states that nothing should be disclosed about any investigation within 60 days of a national election. Of course, there are exceptions in extreme cases; treason for example.

Also, disclosing something this vague and incomplete (to put it mildly) only to Republicans in Congress reeks of partisanship, which the FBI is supposed to avoid. (Yes, I know they have often violated that one in the past.)

To answer your question, Lisa, this is no different; if anything, there are compelling reasons for not disclosing, ESPECIALLY since the FBI doesn't even have a warrant to look at those emails yet.

There are so many things about this steaming mess that stink to high heaven it's hard to know where to begin.
