Voting Rights Court Hearing Today

FEDERAL JUDGE IN WINSTON-SALEM, NC WILL HEAR CASE

Multiple lawsuits against North Carolina, including the age-discrimination case, have been combined into one. A hearing on Monday is over whether to delay the law until a judge decides whether it is constitutional.

Lawyers for the students believe they can make the case that the law is intentionally discriminatory. As proof of this intent, they note that the state prohibited the Division of Motor Vehicles from registering 17-year-olds who will turn 18 by Election Day this fall. All other eligible voters could register there.

3. This is the first hearing on voter id since Wisconsin ruling

A federal court in Wisconsin ruled that Section 2 of the Voting Rights Act invalidated the Wisconsin voter id law. That is the first time that there has has been a ruling on Section 2 of the VRA as to voter id. I know that all of the plaintiffs in the Texas case have made Section 2 claims and I believe that this will be an issue in the North Carolina hearing.

I caution you that these are motions of summary judgments and not the trial in chief. The court may let this case go to trial and not rule on these motions for summary judgments. The Wisconsin ruling set forth above was after a full trial on the issue.
