2016 Postmortem
Related: About this forum"No Balls Holder" ain't gonna bring treason charges, so relax.
If he didn't go after the Bush war criminals (Lets look forward) or bank criminals (it would disrupt the economy and probably future campaign contributions), he ain't going after the Funky 47.
Besides, the Constitution defines treason as giving aid and comfort to the enemy. We ain't at war. Therefore, we ain't got no enemy. Now you could argue that Israel is an enemy, having fired upon a U.S. warship but then you have to connect the U.S.S. Liberty episode with the '47.
So to continue with the treason talk is equivalent to tossing one off. It is our Bengazi. It is a lot of noise but nothing more. Find something more useful to forward progressive programs.

(14,400 posts)hero of the day sure would have done it and then gone ahead and saved us all from Global Warming, made true peace with the Iranians and had Bill O'Reilly fired.
At least try to live in the real world.

(12,296 posts)"The Logan Act (1 Stat. 613, 18 U.S.C. § 953, enacted January 30, 1799) is a United States federal law that forbids unauthorized citizens from negotiating with foreign governments. It was intended to prohibit unauthorized United States citizens from interfering in relations between the United States and foreign governments.[2] The Act was passed following George Logan's unauthorized negotiations with France in 1798, and was signed into law by President John Adams on January 30, 1799. The Act was last amended in 1994, and violation of the Logan Act is a felony."

But, you are correct - Holder doesn't have the balls, even though the grounds are plain as day.

(12,158 posts)It has seldom been invoked and in this case would surely be fast tracked to the Supreme Court where it would be struck down 5 to 4. Charging the 47 with treason high or otherwise will only cause more and perhaps mortal damage to the union of the United States. The only plan that is sensible is to recall and defeat them at the polls. If that cannot work then we are in the deepest of trouble.
I hate what the 47 and the repukes have done to our country but I would hate even more the dissolution of "The Great Experiment" that is our nation. There are some here at DU and some freeper types that would relish the complete breakdown of the country and revolution, but history shows that the outcome of revolution is seldom what the proponents desired. Kill the Tzar and be taken over by Lenin then Stalin. Behead Louis and Marie Antoinette and get the reign of terror which lasts until its architect Robespierre falls under the blade.
Somehow we need to follow Benjamin Franklin advice, "We must hang together, gentlemen...else, we shall most assuredly hang separately." I would hope that we can evolve to the level of being able to eliminate internal strife without having an external enemy, but that seems to be ingrained in human nature.

(32,077 posts)Liberal and conservative DOJs have never used the law in its 216 year history. No one has been prosecuted. Everyone who has taken Constitutional law in Law schools knows it is unconstitutional, including President Obama.

(12,158 posts)So I went with the minimum a 5 to 4 decision since the Logan law has never been enforced.

The criminals? They get the Congressional Medal of Freedom.

The stuff on the Reagan-Bush "October Surprise" was declared "debunked" by the media back around '93, because certain facts were withheld from the public which Clinton would not pursue (the Russian intelligence, for example) and the investigating committee was anxious to close down....
then W. Bush got in office and immediately made a whole lot of files unavailable to the public, particularly concerning his father... Anyway, some evidence on the "October Surprise" didn't come out until fairly recently:

That's a great site, BTW, one might want to dig around in the archives. It was founded by
Robert Parry, who originally broke the Iran-contra scandal.
