Hillary Clinton Aide Bryan Pagliano Invokes Fifth Amendment in Email Probe

WASHINGTON—An aide to former Secretary of State Hillary Clinton invoked his constitutional protection against self-incrimination in front of a congressional panel on Thursday, a move that could prompt investigators to grant him immunity in exchange for his testimony about the Democratic presidential candidate’s personal email server.

Bryan Pagliano, an IT staffer who worked for the State Department and was paid by Mrs. Clinton to help maintain her personal email server, invoked his Fifth Amendment right to refuse to answer questions that could incriminate him, in front of the House Select Committee on Benghazi.

The Republican-led committee subpoenaed Mr. Pagliano, compelling him to appear on Thursday. The committee had prepared 19 pages of questions. The congressional committees investigating Mrs. Clinton’s email arrangement must now decide whether to offer Mr. Pagliano immunity to compel his testimony.

Sens. Ron Johnson and Chuck Grassley, Republican chairmen of the Senate Homeland Security and Judiciary Committees, suggested in a letter last week the House could grant Mr. Pagliano immunity in exchange for his testimony on the matter. Mr. Pagliano’s attorney said that he would cooperate with a committee investigation if an immunity order was granted.

I used to work for Social Security doing disability claims and I'm pretty sure working on the side for a disability attorney would be a no no. What about this sort of stuff?

What I'm getting at here is his 5th a reflection of something he would hide to keep Hillary out of trouble or to shield himself for possible conflict of interest charges?

Here, the problem is that the State Department required anyone working for them to notify them of any other employment they have. It is a condition of working there - no something created to annoy the Clintons. The problem was not that he was working for Clinton, but that he did not disclose that.

For him - not Clinton - it leads to questions of whether he declared the income. (I assume that she treated his compensation as if he was an independent consultant, not an employee of hers.)

How do you know he didn't disclose he worked for the Clintons? He still does work for the State Department on a contract basis. Good grief! Now it's Hillary's fault people need second jobs.

Not to mention, it is just speculation that a reason he might prefer not to speak is that it would document the income he received -- and I went out of my way to explain this was HIS, not her problem.

No one said it was Clinton's fault that he "needed" a second job.

As to concerns for Clinton, it could be that he will have to speak of security if any that he included.

of your income from another source you have to report it to the federal government. This guy did not report the income in the years 2009-2013. That is why he is taking the Fifth.

His lawyer turned down the "proffer" because of concerns that could be interpreted as waiving his 5th amendment rights down the road.

Per the lawyer, they would take immunity.

That problem would not be Clinton's - but his. (She could easily say that she treated him as an independent consultant, not an employee.)

That fact is known. If you are a federal employee and you make more than 15% of your income from another source that must be reported to the federal government. It is known that he did not file reports in the years 2009-2013. Whether he reported to the IRS is not known. So he broke at least one law four times which is why he is taking the Fifth.

I said, "looks like you've got this guy she paid to set up the server, and he's saying he's gonna take the 5th Amendment in front of congress"

She looked at me and said, verbatim: "fuck. Well, i guess it's time to find another candidate"
