BREAKING - Ohio Secretary of State says he will not restore early voting

Just tweeted by Ed Shultz:

https://twitter.com/edshow/status/243059388405919744

And here on TPM:

Ohio Secretary of State Jon Husted said in a memo Tuesday that he wouldn't restore early voting hours for all voters in Ohio until an appeals court examines a federal judge's ruling that restored those rights. The state of Ohio filed a notice of appeal with the Sixth Circuit court on Tuesday.

Our "governor" is doing everything in his power to make it more difficult for the poor to vote. Of course, he's just like us -- he "struggles" to make ends meet on his $187,000/year salary.

So this secretary of state is going to ignore the judge's ruling and do what he wants? Reminds me of the (republican) governors who have said they will refuse to implement Obamacare. There should be some sort of criminal penalty put in place for these asshats.

What, specifically, is he doing in violation of the order?

Considering that the order doesn't have any effect on his PRESENT actions, but merely says that when election time rolls around, the polls have to be open, he can't "violate" the order TODAY, even if he wanted to.

Obviously, he is going to file an appeal, and he can also apply for a stay of the order pending the appeal, but that doesn't really mean a whole lot in either event, since the time at which he will be required to open the polls won't arrive for about another two months.

I hope the federal marshalls knock on his door, drag him into court, where the judge can compel him to explain why he shouldn't throw his miserable ass into jail.

Am I right here?

He's been ordered to have the polls open at stated times in November.

My calendar says it is September 4.

He can't be in contempt, today, even if he wanted to be. But, he can certainly seek an appeal.

In granting a preliminary injunction against early voting restrictions, the judge ruled that the “public interest is served by restoring in-person early voting to all Ohio voters.”
injunction:noun
1. Law . a judicial process or order requiring the person or persons to whom it is directed to do a particular act or to refrain from doing a particular act.

And a violation of a federal law is still a crime even if the application of that law is subsequently overturned.

Throw this clown in jail and call out the federal marshals and the National Guard to enforce the civil rights of these American citizens.

I shouldn't be shocked, but for a public official to just ignore an injunction is unbelievable. And all so he can make it difficult for working people to vote--and in essence commit election fraud himself. What a horrible human being.

You can't be in contempt of an order until you violate it.

He can't violate this order until November.
