Pagliano (Hill Staffer) STILL will not testify despite being granted immunity


Wow wow wow! But that's not even the biggest news coming out of this. Read the last paragraph.
So - she could get elected, then what? Then the truth will come out?
And if this is not resolved and she begins her term as President, THIS will be all anyone will be talking about. She will never get anything done unless she has a veto-proof majority in the Senate and a majority in the House.
How selfish of her to put our country thru this.



Ex-Clinton staffer again says no to testifying to Congress

WASHINGTON (AP) — A lawyer for the former Hillary Clinton staffer who helped maintain her private email server has told Congress that his client still will not appear before Senate committees investigating the matter.

The Senate committees on the Judiciary and Homeland Security committees had renewed their request to question Bryan Pagliano about the server after news broke that the Justice Department, which is also investigating the server, had offered him immunity.

Committee leaders had told Pagliano that the immunity grant should relieve any concerns he had about being prosecuted if he testified and they requested that he appear before them. He had refused to speak with lawmakers last year, invoking his Fifth Amendment right against self-incrimination in declining to answer questions about the server and email setup.

But Pagliano's attorney, Mark MacDougall, said in a March 11 letter obtained by The Associated Press on Friday that Pagliano would continue to "respectfully decline" their invitation.

MacDougall also stressed that Pagliano had "not waived his rights under the Fifth Amendment as a matter of fact or law," though he did not provide any details about the grant of immunity.

"With all appropriate respect, whether and when a citizen may assert a constitutional right is not up to your legal staff," MacDougall wrote. "Whatever agreement Mr. Pagliano may have reached with the Department of Justice in no way constitutes a waiver of his Fifth Amendment rights."

The Clinton campaign has said that it encourages Pagliano and anyone else with information about the server to cooperate and answer questions.

FBI Director James Comey said at an event Thursday in London that there is no timetable for the FBI to resolve its investigation into whether sensitive government information was mishandled on the email server.

Although we all wish for a speedy resolution, I think it's more important for the FBI to do a thorough and politically impartial investigation.

...I suspect it would be to clear her, not to get an indictment. That they're taking their time indicates to me they have a decent case, and are dotting the i's and crossing the t's. IMO, the FBI will reccomend an indictment of Clinton and/or top aides. I do not know if Lynch will follow up on that reccomendation. If she avoids legal prosecution, I am certain the GOP will still move towards impeachment if she's elected.

The 5th Amendment against self-incrimination no longer applies after a grant of immunity.
He MUST answer a subpoena, and MUST testify, or face indeterminate jail time for contempt
UNTIL he does testify.

...or at least that is the way I understand WHY immunity is ever granted. It forces testimony.

Those are the terms used in the article. There's no indication that the committee has issued a subpoena, which, per your post, would be the necessary predicate to a contempt citation.

The committee may have shied away from issuing a subpoena for fear of being accused of interfering with the DoJ investigation. Alternatively, the committee may have thought that Pagliano's appearance would be more productive in the more relaxed atmosphere of a more or less voluntary appearance. On that view, now that he's declined the request, a subpoena may be forthcoming forthwith.

According to the linked article, it was the Department of Justice that offered immunity, not the Congressional committee.

A committee is generally looking for public testimony. The DoJ, on the other hand, will want to start by privately interviewing an immunized witness, although there may be testimony down the road.

I was thinking Warren should stay in the Senate. But if this isn't resolved before the proper time, a realistic replacement might be desired.

With Pagiliano it's the Senate committee that he won't cooperate with.
It still looks bad because by refusing to do so it looks like he has something to hide & won't be able to stand up to their witch hunt.

It sounds like he's worked for Clinton's for a while. State Dept people said they never saw him...sounds like he was collecting a govt paycheck while doing private work for Clinton.
