The FBI report, the News cycle, poll numbers, primaries and internet chatter.

Last edited Wed May 25, 2016, 02:42 AM - Edit history (2)

First off

From what I've read so far Hillary disregarded or broke federal laws, so I'll give those laws

1. Mishandling Classified Information

Executive Order 13526 and 18 U.S.C Sec. 793(f) of the federal code make it unlawful to send of store classified information on personal email. Casey Harper at The Daily Caller delved into this angle:

“‘By using a private email system, Secretary Clinton violated the Federal Records Act and the State Department’s Foreign Affairs Manual regarding records management, and worse, could have left classified and top secret documents vulnerable to cyber attack,’ Cause of Action Executive Director Dan Epstein said in an email to reporters.

‘This is an egregious violation of the law, and if it were anyone else, they could be facing fines and criminal prosecution.’”

2. Violation of The 2009 Federal Records Act

Section 1236.22 of the 2009 National Archives and Records Administration (NARA) requirements states that:

“Agencies that allow employees to send and receive official electronic mail messages using a system not operated by the agency must ensure that Federal records sent or received on such systems are preserved in the appropriate agency record keeping system.”

According to the original story on Clinton’s emails published in The New York Times:

“Federal regulations, since 2009, have required that all emails be preserved as part of an agency’s record-keeping system. In Mrs. Clinton’s case, her emails were kept on her personal account and her staff took no steps to have them preserved as part of State Department record.

In response to a State Department request, Mrs. Clinton’s advisers, late last year, reviewed her account and decided which emails to turn over to the State Department.”

The fact that the State Department combs through the 55,000 pages of emails sent on Clinton’s private email account seems to verify that at least some of the emails Clinton sent contained classified information.

3. Violation of the Freedom Of Information Act (FOIA)

Veterans for a Strong America has filed a lawsuit against the State Department over potential violations of FOIA. Joel Arends, chairman of the non-profit group, explained to the Washington Examiner that their FOIA request over the Benghazi affair specifically asked for any personal email accounts Secretary Clinton may have used:

“‘At this point in time, I think we’re the only ones that specifically asked for both her personal and government email and phone logs,’ Arends said of his group’s Benghazi-related request.”
MSNBC’s Lawrence O’Donnell believes that the use of a personal emails server appears to be a preemptive move, specifically designed to circumvent FOIA:

“‘Hillary Clinton’s system was designed to defy Freedom of Information Act requests, which is designed to defy the law.'”

OK,

There may be more things they find ie. Clinton Foundation, but regardless
of the FBI report and suggestions to the Justice Department or what Justice decides........ that another news cycle and discussion even if she gets just a slap on the wrist or a tongue lashing from the FBI or the Justice dept.

I want to talk about the next on my list.

The News Cycle

When this 'story or report' breaks, what do you think all the TV news cycle will do? They will have at least a 24/7 talk fest with all the pro/con talking pundits discussing this. The internet will be on fire discussing the findings.
With her defenders and detractors arguing endlessly.
And what would this do to her poll numbers?

Poll numbers

Her poll numbers during this cycle will not go up,but take a hit, in fact she will have to address the report findings to reporters there is no way she can avoid this like she did the debate in California. Her poll numbers will go down, I guarantee it. She might handle the reporters well or not but that continues the news cycle. Trump will go to town on this, no matter how much we dislike Trump he is a master manipulator of the media and brilliant with his ugly one liners. Sanders will just say.. 'her damn emails''..... and emphasis on 'damn.'. “I’ve been asked 5 million times about the emails, and I haven’t said anything,” Sanders said in a brief interview before a rally here. “I’ve been asked about the Clinton Foundation, didn’t say anything. Bill Clinton’s personal life? Never said a word. (sacbee.com)

Remaining Primaries

Depending on the timing of the FBI release of the report it will have significant bearing on the remaining primaries and hurt her chances to tie the whole thing up.

Democratic convention

Once again an unknown depending on what the Justice department suggests. But it adds to the 'Messy Convention' equation Bernie is talking about.

General Election

If she is the nominee vs Trump... The FBI report discussion will continue to be a thorn in her side and the Democratic Party.

I don't like my scenario but I think its accurate.

My other scenario is Go Bernie....you need to go all the way.......but that's another story.

...I had the horrific thought of what a terror warning would do to the election. She is desperately going to need to grab the news cycle. I recall that many people felt that the airliner that went down in Queens on the day that very bad news of the election 2000 study were due out was assigned to Karl Rove. I have seen others mention that a terror warning would help Trump. But if it could be engineered to help Hillary.......

Ugh.

Manipulated by the PTB so I would expect that factor added to my scenario depending who they want to through their weight behind. So yes, expect something else to stir up the masses or distract them.

Very different effect if the report comes out early in the week. Interesting point being made here.

I've been mulling over this question, as well.

Within the confines of the Trump campaign, Hillary campaign, Democratic Party heads, Republican Party heads and the Sanders campaign. It would be totally delusional if they didn't.

Yes the timing of the release of the report early in the week is important in the short run for the primaries

but in the long run it will impact this election until the final vote is cast in November if she is our nominee including house and senate seats.

Who have placed their bets and invested , resources and reputations to get her in power.

They will of course have to defend her and even convince her to stay in the fight and her ego and pride will agree. Unless the party elders think otherwise and see the coming disaster like I do and convince her to step down for the sake of the party it will be like a snowball growing down mountain until it reaches an avalanche of Senate and House hearings since the repugs control both houses. National Security is a hot button issue for the US consciousness especially after 911.

I followed the Watergate saga from the beginning before it went national and this affair has a lot of the same smell. Nixon won that election even though Watergate happened way before that election.

Maybe the system now is so corrupt now that nothing will happen but I don't think so............Something will happen and it won't be good
.

The truth is stranger than fiction
Fiction has to make sense.

for real change. He blows me away with his vigor and vision.

And he might and will be a bigger player in this total affair than even he can't conceive.

Time will tell all the way to the convention and even after the election no matter how it comes down.

It will be a bumpy wild ride so fasten your seat belts

the election.

My guess is that, regardless of the facts, the House Republican will start holding hearing, perhaps impeachment hearings, as soon as she is elected (if she is) in order to create the following narrative:

1) She broke various laws and protocols with her email and phone communications that show she can't handle classified communications needed to maintain national security.

2) Her server was hacked.

3) Her hacked emails were the source of information that was used by terrorists to their advantage. There is already an account circulating saying that this seems have been the source of information that a terrorist group used to avoid capture in the Philipines.

4) Hacked information is how terrorists found out that Benghazi was the site of a CIA "rat line" smuggling arms to Syria. I have been expecting this allegation to start circulating any day, given the Republican fetish for Benghazi.

And this all may be true. But even if it is not, it shows that she was willing to take these risks to protect her political career, which she felt was more important than national security interests.

and she is worse now with her Romanian hacker and all the rest. Without even getting into her husband's issues (which I only bring up because she says he will have a substantive role of fixing the economy should she somehow be elected).

I'd really like to know who sold us out here. Was it the DNC - is Wasserman Schultz really in it for the republicans?

I adore Bernie and will support him as long as he's running - but I'm still amazed that the party couldn't come up with someone new to run rather than dredge up all this stuff. This election is a mess.

He had enormous influence on the direction of the party and never forget his roaring speeches on the senate floor and even his endorsement of Barack Obama. He helped keep the party in check and he was Obama's mentor and kept him from straying from the path.

I think Obama's presidency would have been much different if Kennedy had lived.

After he died
He left a huge vacuum that the third way and the dark forces took advantage of.

from GDP

Jeff Weaver on CNN: Bernie is not going to make a point about the State Dept IG's report.

He said that it's part of a process and they're going to allow that process to continue. The interviewer pressed him on it, saying the investigation is over, why not comment on it now, and Jeff replied that people can draw their own conclusions.

Monday is a national holiday - will it be a slow news day? Then we've got all the Republican talk shows on Sunday. Hmmmm - I say again, Hmmmm.
