Elizabeth Warren proposes criminal penalties for spreading voting disinformation online

Democratic presidential candidate Elizabeth Warren on Wednesday released a plan to fight disinformation to hold tech companies accountable for their actions in light of the 2016 election.

“Disinformation and online foreign interference erode our democracy, and Donald Trump has invited both,” Warren said in a Tweet Wednesday. “Anyone who seeks to challenge and defeat Donald Trump in the 2020 election must be fully prepared to take this on – and I’ve got a plan to do it.”

Warren proposed to combat disinformation by holding big tech companies like Facebook, Twitter and Google responsible for spreading misinformation designed to suppress voters from turning out.

“I will push for new laws that impose tough civil and criminal penalties for knowingly disseminating this kind of information, which has the explicit purpose of undermining the basic right to vote,” Warren said in a press release.


"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

to vote on a certain day. Of course that day was one day after the election. It was a felony and could possibly be used as a precedent for this law.

Some felonies make you lose your voting rights. I'm sure the 2 Wichita natives were comfortable not being allowed to vote in the Carolinas.

Like, if I post misleading information about voting on Twitter, it looks like she wants to punish Twitter--but I wouldn't face any punishment. Which seems odd. How would the individual responsible not face consequences?

any more than shouting fire in a theater. Any court that ruled so would be wrong. There should be federal statutes governing intentionallly providing voting misinformation.

However, I still see the potential for First Amendment issues, and also for enforcement issues. Neither is any reason to give up on the idea, but both are reminders to be very, very careful in drafting the legislation.

Such terms make possible gigantic layers of interpretation possible--and not only "possible," but necessary.

Who is the officially appointed gatekeeper for true information? What are their biases and who chooses those gatekeepers?

With so much information available we should trust people to absorb and disseminate news and information for themselves and be responsible for their own opinions.

to publish the misinformation might be the only thing you can realistically do and it's about time. It's easier than tracking down and proving the guilt of the actual posters who might not even be US citizens.
If I'm not mistaken, similar laws have been created in the EU, for example regarding hate speech.

Besides being blatantly unconstitutional and unenforcable, it doesn't address the real problem. The real problem is systemic voter disenfranchisement. People are being thrown off the voting roles, being prevented from voting, or having obstacles that make voting difficult. I guarantee that if these things were overcome, we wouldn't have to worry about the squishy middle that is easily swayed by propoganda. What infuriates me is when pundits refer to low voter turnout without ackowledging this.

I don't get that.

But there are also people who spread false voting dates, for example. I think that should be criminally punishable. And, it is easy to know what the true date actually is.

But, to your issue, I think we should totally be able to criminalize disenfranchisement. How about, one year in prison for every lawful voter who is removed from a voting role incorrectly? that might make the GOP more cautious about who they throw off the role.
